California is on the brink of enacting a unprecedent bill, AB 2602, aimed at safeguarding performers from unauthorized use of their digital likenesses by artificial intelligence (AI). This legislation, which has garnered bipartisan support, mandates informed consent and representation for performers before their digital selves can be utilized, covering a broad spectrum from on-screen actors to voice and motion capture artists in various media. The bill’s passage reflects a significant stride in addressing the entertainment industry’s concerns over AI, highlighted during last year’s Hollywood strike.
Additionally, California’s legislative efforts include AB 1836, protecting deceased performers’ digital replicas, and the national “NO FAKES Act,” proposing to outlaw creating digital replicas of any American. These moves come amidst a wider push to regulate AI technologies, such as California’s SB 1047, focusing on AI models like ChatGPT.
